I've been waiting since November 22, 2010 for a BN Optimus 1350 to arrive from Poland. The eBay seller XMAGNUS said it would "arrive Dec 10-Dec 23". After repeated messages about it I kept getting the "Please be patient, it will come" BS. Well, it came today, WITH A DENTED FOUNT! Mind you, NO DENTS shown in ANY of the images on the eBay sale site. It gets even better. Because the time elapsed between the sale and arrival has exceeded 45 days, I can't file a claim with eBay for their "Buyer Protection". After numerous phone calls to them where I was disconnected THREE times by "agents" that can hardly be understood I'm still waiting to speak to a "supervisor". One of said agents told me to contact IC3.gov. That's the US Gov't Internet Fraud Division. So I filled out the complaint form. No word from the seller after two emails to him. I almost wonder if it wasn't a case of "bait and switch"? I'm PI$$ED! Footnote: After talking to SIX eBay agents I ended up talking to "Alvie". Alvie knew his way around the "45 Day Syndrome". So now at least I have a case filed. WHEW! Why didn't the TWO "supervisors" I talked to know how to manually over ride the parameters to start a case? Hmmm? The ball is in the seller's court now. Bob

Some Ebay Sellers really suck, About 3-4 months ago I won a Coleman 242 K. I suspect the seller was offered more after the Auction closed. After many varied excuses, he could not provide proof of postage so a claim was made. I received money back but would have preferred the Lantern. Now 242 K's are pretty rare as we all know. It's interesting how a fellow collector in the US was talking on a Forum about a 242 K he received from a friend in Australia one month after I resolved the claim. Hmmmmmm ... 1 + 1 = 3 I blame the cretins that work outside Ebay, I know a few and refuse to have any dealings with them. ... and then there is the Auction rigging that goes on, been caught with that one too. So I get a "message" from this seller with regard to the damage: "I always packed very well all my deliveries but damages can still been made after that becouse of other people who are unpacking it to check content (from Post Office, Customs and Border Protection) and I can't guarantee safety delivery in 100%." SAY WHAT???? Let me tell you something SIR, I have bought lanterns from Sweden and Germany and NONE OF THEM arrived with any shipping damage. This was packed by an amateur. The "fat lady" hasn't even sprayed her throat on this deal. It really sours one with respect to doing business internationally if this is what I have to contend with. Bob - good luck with the war I hope you mange to resolve it. usually lantern damage is caused by less than perfect packing.
There's a reason I've done very little buying on ebay for a long time. Too many thieves and scammers. The last pressure lamp I bought on ebay arrived with a hole in the font (not shown, and condition was described as "no damage."). I've also had glass items arrive in pieces, just stuck in a box (doomed to be broken). The last thing I bought on ebay was a sandwich glass whale oil lamp, I was very glad when it arrived in one piece and not a dozen or more... Best of luck with the complaint, maybe you can get your money refunded through paypal, but who knows...
I settled for a $150 partial refund from this seller. Let's hope this has taught him a lesson that ultimately the person shipping is responsible for packing an item so that shipping damage CANNOT HAPPEN. I learned one too. I ALWAYS gave sellers my "Packing Spiel" and made them acknowledge that they would comply before I paid them. I didn't do it this time. NEVER AGAIN! Bob
I always used to advise on how things should be packed, but havn't done so for some time. I think I'll have to start again.
